General

We believe in protecting your privacy. This Privacy Policy explains how your information is protected, stored and used. By using our Services, you consent to our terms of service, the terms and conditions of this Privacy Policy and you are aware that our policies may evolve in the futures.

We may make changes to this Privacy Policy from time to time. When we do, we will revise the “last updated” date given above. It is your responsibility to review this Privacy Policy frequently and to remain informed of any changes. The then-current version of this Privacy Policy will supersede all earlier versions. All updates and amendments are effective immediately upon notice, which we may give by any means, including, but not limited to, by posting a revised version of this Privacy Policy or other notice on the Website. If we make material changes to this Privacy Policy you will always be notified through email or via an in-app notification.

You agree that your continued use of our Services after such changes have been published to our Privacy Policy will constitute your acceptance of such revised Privacy Policy.

Information we collect

Prezly (“Prezly”, “we”, “us”, “the Company” and terms of similar meaning) provides online software, which can be used to manage and reach out to the Customers’ contacts (media relations, social influencers, internal contacts). It allows the Customer to publish stories online and email these stories to their contacts.

The contacts can visit specially designed Press Rooms created by the Customer but hosted by Prezly. This means Prezly collects both personal data and non-personal data, not only from its Customers, but also from Customers’ contacts who visit the Press Rooms.

Personal data means any personal information that could identify you as a customer and you as a visitor of the Customers’ Press Room, directly or indirectly, including but not limited to first and last name, date of birth, email address, occupation or other demographic information as well as behavioral data such as the opening of an email and clicking links in an email received from Customer through Prezly.

Non-personal data means any information that doesn’t allow us to identify you as a customer or you as a visitor of the Customers’ Press Room, but that allows us to provide the best possible service to our Customers. This includes information such as, but not limited, how and when you use the service, which browser you use, etc.

Data Collection from Prezly Customers

This section describes our policies for users of the Prezly homepage (https://www.prezly.com) and Prezly Backend (https://rock.prezly.com), Prezly Customers, and corporate partners.

Personal and non-personal data

We receive and store any information you enter on the homepage or through the backend or provided to us in any other way.

We use personal and non-personal data provided by you for such purposes as responding to your requests for services, customizing the content you see, communicating with you about our products, and marketing our services to you.

In order for you to use all of our features, you must register with Prezly. We require your email address and password during the registration process. Information you enter is for example your name, address, email address, phone number, location. We may also collect and store other details like ip address, web browser, purchase history and other demographic information.

By giving us both personal and non-personal data, you consent explicitly to this data, and data received from other sources being collected, used, disclosed, and stored by us.

Cookies and tracking technologies

Prezly may use various technologies to collect and store information when you use our Services. This may include the use of cookies or similar tracking technologies such as web beacons.

Cookies are identifiers transferred to your computer’s hard drive through your Web browser to enable our systems to recognize your browser and tell us how and when pages in our Press room are visited and by how many people. Like most internet sites, Prezly uses cookies to enhance our visitors’ and customers’ experience on the internet. Most browsers allow you to prevent the browser from accepting new cookies, to be notified when you receive a new cookie, or to disable cookies. You as a Customer can therefore control the use of cookies at the individual browser level.

We receive and store certain types of information whenever you as a customer interact with us. Prezly automatically receives and records “traffic data” on our server logs from your browser including your IP address, cookie information, and pages you request. Prezly uses this traffic data to analyze trends and administer the site. Our service automatically collects usage information, such as the numbers and frequency of visitors to our site and its components. As mentioned above, this data is only used in the aggregate and to improve our services for Customer purposes.

This type of collective data enables us to figure out how often users use different parts of the site and services. In addition, we may provide statistical collective user information, not identifiable information about the Customer, to our partners so that they understand how often people use specific components of our site and services.

Email and in-app communications

Prezly will communicate with you about its services by email. You consent to receiving such emails or via In-App messages. If you contact us via email through the site, we may retain a record of your contact information and any information you provide us in your message to respond to you. We may receive a confirmation when you open an email from Prezly.

We may also send emails with service updates, news or promotions. If you do not want to receive email from us, please use the unsubscribe link below the email or contact us at privacy@prezly.com.

Data collection from visitors of Press Rooms

This section describes our policies for you as a visitor of a Press Room hosted by Prezly.

Personal and non-personal data

In the course of providing user and usage data analytics services to our Customers, Prezly collects both personal and non-personal data from visitors of Press Rooms.

Personal data collected by Prezly about you as a visitor of Press Rooms includes data such as your name, address, age, phone number, email address, type of activity, social media accounts, organizations you’re linked with, which you have provided to the Customer.

Prezly will not collect personal data which you haven’t provided to the Customer or which you haven’t explicitly agreed to.

Prezly also collects non-personal data about you from Press Rooms you visit, including the following types of data: common information found in every communication sent over the internet, information such as browser type (e.g., Chrome or Internet Explorer), operating system (e.g., Macintosh or Windows), browser language (e.g., Java or Unix), internet service provider (e.g., Verizon Fios or AOL) and how you use our Press rooms and various pages on the internet.

Prezly uses hCaptcha service for the protection of Subscribe email collection, where hCaptch Privacy Policy and Terms of Service apply.

Prezly may use this personal and non-personal data to provide our Services to our Customers.

Use of cookies and tracking technologies

As mentioned above, we make use of Cookies and tracking technologies.

This type of data enables us to figure out how often users use different parts of Press Rooms. In addition, we may provide statistical collective user information, not information about you personally, to our Customers so that they understand how often people use specific components of Press Rooms.

Sharing of personal data

This section describes our policies for sharing personal data received from either Press Room visitors, Prezly homepage visitors or Prezly Customers.

We maintain confidentiality

We neither rent nor sell personal data to anyone. We maintain the confidentiality of your personal information and share your Personal information only as described hereunder.

Affiliated businesses we do not control

Prezly may provide services or sell products jointly with affiliated businesses. We will share customer information that is related to such transactions with those affiliated businesses that is necessary to provide you the Services. However, we require our affiliates to provide the same level of privacy protection that we do. They do not have the right to share or use personal data for any purpose other than for an authorized transaction.

Agents

We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products and services. Examples include billing, processing payments, providing marketing assistance, and providing customer service. Our agents subscribe to the same level of privacy protection as we do. Unless we tell you differently, Prezly does not share, and Agents do not have any right to use personal data collected from our Site and Services beyond what is necessary to assist us. Financial and billing information is collected through the Site and Services directly by a third-party intermediary and is used solely to bill for the Services. Prezly does not receive your billing information from this third-party intermediary, who may store, retain, and use the information provided solely for the purpose of credit card processing.

Promotional offers

We may send offers to our customers on behalf of other businesses or provide our customers with the opportunity to notify end users directly of promotions by text messages or email. If you do not wish to receive these offers, please email us at privacy@prezly.com.

Business transfers

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if Prezly, or substantially all of its assets, were acquired, user information would be one of the assets that is reviewed and transferred. You acknowledge that such transfers may occur, and that any acquirer of Prezly may continue to use your personal data as set forth in this Privacy Policy.

Protection

We may release personal data when we in our sole discretion believe in good faith that release is necessary or appropriate to comply with the law, enforce or apply our conditions of use and other agreements, or protect the rights, property, or safety of Prezly, our agents, our Customers, or others.

Your consent

Except as set forth above, we will not share personal data collected from Prezly Customers or end users with third parties without your consent.

General Data Protection Regulation

The EU General Data Protection Regulation (“GDPR”) replaces the Data Protection Directive 95/46/EC and was designed to harmonize data privacy laws across Europe, to protect and empower all EU citizens privacy and to reshape the way organizations across the region approach data privacy.

According to protect the privacy of its Customers and visitors of the Press Rooms hosted by Prezly, the following clauses are part of our Privacy Policy in order for PREZLY to be GDPR compliant.

The data

As set forth under the title “information we collect”, Prezly collects both personal data and non-personal data, not only from its Customers, but also from Customers’ contacts who visit the Press Rooms.

Personal data means any information that could identify you as a customer and you as a visitor of the Customers’ Press Room, directly or indirectly, including but not limited to first and last name, date of birth, email address, occupation or other demographic information.

Non-personal data means any information that doesn’t allow us to identify you as a Customer or as a visitor of the Customer’s Press Room, but that allows us to provide the best possible service to our Customers. This includes information such as, but not limited, how and when you use the service, which browser you use, etc.

Storage and transfer of data

Prezly engages third party sub-processors to process personal data on Prezly’s behalf. The Sub-processors currently engaged by us and authorized by the Customer are the following:

  • Database (postgres): Ireland, Dublin, Amazon Web Services

  • Logs (elastic): Ireland, Dublin, Amazon Web Services

  • Backups: St. Ghislain, Belgium, Google

  • Assets: CDN (worldwide), Uploadcare

Prezly shall notify the Customer in advance of any new Sub-processor being appointed.

We will only transfer data outside of the EU to Third Countries that offer an appropriate level of data protection.

Access and removal of personal data

If you want to access, make changes, request a removal, request a stop in processing, or request a transfer of the data Prezly or Prezly’s Customers collected about you. These actions can be requested at any time by visiting the subscription management page linked at the bottom of each email sent through Prezly.

Prezly will automatically delete unused personal data. This means for example the data for Customers whose contracts haven’t been renewed will be deleted.

Prezly appointed a Data Protection Officer, Mr. Gijs NELISSEN. If there is any problem concerning data protection, please email him at privacy@prezly.com

The data Protection Officer has to inform and advise you about your obligations pursuant to the GDPR.

Security

Your Prezly account information is protected by a password for your privacy and security. We use industry-standard Secure Socket Layer (SSL) software to protect the security of your personal information during transmission, which encrypts all of the information you input. Only employees or agents who need personal information to perform a specific job are granted access to it. All of our employees and agents are kept up to date on our privacy and security practices and are informed about the GDPR regulation.

International visitors

For users outside the EU, please note that any personal data you enter into Prezly will be transferred out of your country and into the EU. You consent to such transfer through your use of Prezly. You also warrant that you have the right to transfer such information outside your country and into the EU.

Use by children

Prezly is not intended for children. If you are under 18, you may use Prezly only with the supervision of your parent or guardian.

Third Party Sites

Prezly may permit you to link to other websites on the internet, and other websites may contain links to Prezly. These other websites are not under Prezly’s control and Prezly is not responsible for the privacy or security practices or the content of such websites.
